Legal Requirements for Short-Term Rentals in Colombia
Colombia has consolidated its position as an attractive destination for real estate investment, especially in the market for short-term rentals or daily stays. However, this type of operation requires compliance with a series of specific legal requirements. In this article, we cover everything you need to know to operate within the Colombian legal framework.
Legal Requirements for Short-Term Rentals
The daily rental model has gained popularity in various cities across the country, such as Medellín. Although permitted, its practice is regulated by law, and failure to comply with the requirements can lead to penalties and restrictions. Below, we explain the most relevant aspects:
National Tourism Registry (RNT): Every property offered for short-term rental must be registered with the National Tourism Registry (RNT), as stipulated by Law 2068 of 2020. This is a mandatory process that is carried out virtually, takes approximately five days, and must be renewed annually.
Accommodation Registration Card (Tarjeta de Registro de Alojamiento): Once the property is registered, it is mandatory to document each guest using an Accommodation Registration Card.
Horizontal Property (PH) Conditions: If the property is subject to the horizontal property regime, it is essential to verify that daily rentals are expressly authorized in the horizontal property regulation (Reglamento de Propiedad Horizontal). If this use is not contemplated, the building administration can prohibit this type of rental and restrict guest access. It’s important to note that rentals exceeding 30 days cannot be limited by the internal regulation.
Mandatory Civil Liability Insurance: Since January 2022, those who offer properties for short-term rental must have a civil liability insurance policy that covers potential damages, accidents, or injuries caused to third parties during the guests’ stay.
Obligations of the Co-property Administrator: If rentals are carried out without meeting the legal requirements, the administrator of the building or residential complex is obligated to report it to the Superintendency of Industry and Commerce (SIC). The omission of this duty can lead to penalties of up to three times the current monthly minimum legal wage.
